Terminated without notice — what you can actually claim
Your remedy depends on whether you are a workman. The distinction decides everything, and most people are told the wrong thing about it.

Indian employment law splits at a single question, and almost every other answer follows from it: are you a workman?
Why the classification decides everything
Employees engaged in manual, skilled, technical, operational or clerical work generally qualify as workmen. Those employed mainly in a managerial or administrative capacity, or in a supervisory role above the prescribed wage threshold, generally do not.
It turns on what you actually did, not what your designation said. An "Assistant Manager" who supervised nobody and had no authority to hire, discipline or sanction spending has a real argument for workman status. Conversely, a genuine department head does not become a workman because the offer letter called the role something modest.
If you are a workman, you have access to the Labour Court and the Industrial Tribunal, and the remedies are substantial — reinstatement, back wages, and a requirement that the employer followed due process before dismissing you.
If you are not, your remedy is contractual. In practice that means damages for breach, which usually amounts to pay in lieu of notice. Indian courts do not ordinarily order specific performance of a contract of personal service, so reinstatement is not realistically available.
What you can claim either way
- Notice pay — as the contract provides, unless the termination was for proven misconduct following a proper inquiry
- Unpaid salary to the last working day
- Leave encashment for accrued, untaken leave
- Gratuity under the Payment of Gratuity Act, 1972, generally after five years of continuous service
- Provident fund — your accumulated balance, which is yours regardless of how the employment ended
- Any earned but unpaid variable pay — harder, and turns on how the incentive plan is worded
Preserve this now
Employment cases are won on documents, and access to company systems is usually cut the same day.
- Appointment letter and every subsequent revision
- Salary slips for at least the last twelve months
- Appraisal and performance records — particularly good ones, if the termination is framed as performance-related
- The termination letter or email, and anything preceding it
- The full email trail on the relevant events
- Any WhatsApp exchange with your manager or HR
Forward what is legitimately yours to a personal address before you lose access. Do not take confidential company material — that converts your case into their case.
Resignation demanded instead of termination
Employers frequently ask for a resignation "to keep the record clean." Understand the trade. A resignation ordinarily forfeits any claim for wrongful termination, and it can affect eligibility for certain terminal benefits.
It is sometimes still the right call, where the reference matters more than the claim. But it should be a decision made with the consequences understood and preferably with the terms recorded in writing, not something conceded in a meeting.
Non-compete clauses
Post-employment restraints preventing you from joining a competitor are generally unenforceable in India as a restraint of trade under Section 27 of the Indian Contract Act.
Confidentiality obligations and non-solicitation of clients or staff stand on different and considerably stronger footing. So the clause telling you not to work in the industry for a year is usually toothless; the clause telling you not to take the client list with you is not.
Where these matters go
Workman claims go to the Labour Courts and Industrial Tribunals, generally after conciliation before the labour authorities. Contractual claims go to the civil courts. Gratuity claims go to the Controlling Authority under the Gratuity Act. In Delhi these sit within the district court system at Karkardooma, Dwarka and Rouse Avenue.
