How it works

  1. Notice to the opposite partyNot mandatory but frequently effective, and it demonstrates good faith to the Commission.
  2. File the complaintComplaint with affidavit, invoices, correspondence and proof of payment, with the prescribed fee.
  3. HearingConsumer proceedings are summary in nature and largely document-driven, with limited oral evidence.
  4. ExecutionCommission orders are executable, and non-compliance carries penal consequences.

Common questions

Do I need a lawyer for consumer court?

You may appear in person, and the Act is designed to permit that. In practice, matters against insurers, builders and banks are defended by experienced counsel, and complainants without representation are frequently outmatched on procedure rather than merits.

What can I claim apart from a refund?

Compensation for loss and mental agony, interest, and litigation costs are routinely awarded in addition to refund or replacement. In appropriate cases Commissions also award punitive damages.

Can I file a consumer complaint against a builder and go to RERA as well?

Both forums are available, and the Supreme Court has held that RERA does not oust consumer jurisdiction. You cannot, however, pursue the same relief in both simultaneously — the choice of forum needs to be made deliberately.
