Common questions
The debt is more than three years old. Is it gone?
Not necessarily. If the debtor gave a written acknowledgement of the debt or made a part payment before the three years expired, limitation restarts from that date. A ledger confirmation or an email admitting the dues can be enough.
What is a summary suit and why is it better?
In an ordinary suit the defendant can contest as of right. In a summary suit under Order XXXVII, the defendant must first obtain the court's leave to defend, and leave is refused where there is no genuine defence. It is materially faster where you hold a written contract or cheque.
Can I recover interest as well?
Yes, where the contract provides for it, and courts also award interest under statute in many cases. Registered MSMEs have a specific statutory entitlement to compound interest on delayed payments.
